Cancellation and Returns Policy:
You may cancel your contract with Fanshop24 without giving reasons within a month of closing the same, either in written form (via mail fax, or email), or, in the case of a delivery of your order before the lapse of time, by returning your purchased item. The period of revocation begins after the receipt of a separate, written notice of revocation (either one day after delivery; or, in the case of a recurring delivery of similar products, the day after the receipt of the first part-delivery. Also, the time period does not begin before our fulfillment of duty to supply information in accordance with § 312c para. 2 BGB (German Civil Code), in connection with § 1 para. 1, 2 and 4 BGB-InfoV, as well as our duties concerning electronic business dealings in accordance with § 312e para. 1 Clause 1 BGB in connection with § 3 BGB-InfoV).
A timely sending of your notice of revocation or a timely dispatch of your ordered items is sufficient in order for you to remain within the cancellation period.

Consequences of revocation:
In the case that a revocation takes effect, the received goods and services are to be mutually reimbursed, as well as any potential benefits that may have been received (e.g. interest, compensation for use).
If it does not prove possible for you to refund the received goods or benefits completely but only in part or in lesser quality or condition, you may be required to provide adequate value replacement.
This may lead to you having to pay all expenses which you committed to within the time period before your revocation notice. However, this does not apply in the case of a surrender of goods if the limited quality can doubtlessly be attributed to its quality inspection, such as would have been offered to you in a store. You may also note that your obligation to pay compensation for a worsening of condition caused by the appropriate use of the product can be avoided if you take care not to treat the item as your own, and do nothing which may affect its value.
Mail-transportable items are to be returned by post at our cost and risk. If the delivered product matches your order and its price does not exceed 40 Euros; or, in the case of an order exceeding this amount and if at the time of revocation you have failed to compensate for your order, or paid a contractually appointed down-payment, you are responsible for paying the postal cost.
In all other cases, you may return your order by post free of charge. Non mail-transportable items will be picked up at your door.
Payments must be refunded within 30 days. For you, this period begins with the sending of the notice of revocation or, alternatively, the product; for us it begins with their receipt.
The revocation right does not apply in the case of
End of Returns Policy.
Conclusion of contract
The order placed by the purchaser is a binding offer. We reserve the right not to carry out orders in the case that a product is not deliverable. Additionally, we reserve the right to minor product changes.
We are entitled to confirm your order within 4 weeks of purchase by acceptance of order via email, in written form, or by the dispatch of the ordered product(s).
The contract comes into existence once the acceptance of order has been sent, or the product has been dispatched. The automatically generated order confirmation does not constitute the acceptance of the order.
Our product specifications and our pricing within the order transaction are without obligation. The substantial criteria of the products and the services of FanSport24, including pricing and interest, as well as any other specifications in the contract, result from the individual product descriptions.
Check the order confirmation for obvious miscalculations and clerical errors, as well as for any discrepancies concerning your order, order confirmation and delivery. You are responsible for communicating any inconsistencies to us. If you or we insist on reversing the transaction due to a discrepancy, please do not open the product or product’s packaging any further. Otherwise you are obliged to cover the cost of any loss in value of the product. In cases of such inconsistencies, please return the product to the address you find printed on the delivery bill. We carry the cost of the postal return or collection, if the inconsistencies were not discovered by you before the delivery and you were therefore unable to inform us beforehand.
Maturity, Payment, Reservation of Proprietary Rights
The purchase price falls due at delivery. The prices which apply are those listed on the respective valid websites at the time of order. VAT is included in the product price.
Payment is to be made according to one of the payment methods offered to the buyer on the online-order form. If you choose to pay by cash on delivery, the postal service will charge you a 2 Euro fee, which must also be paid cash on delivery. If you choose to pay via credit card, your account will be debited at data input. An additional fee of 1,99 Euros is charged.
In the case of a return or failed credit card payment you automatically and irrevocably permit your credit card issuer or bank to inform us of your name and current address.
The delivered item(s) remain under our ownership until full payment has been made.
Delivery, Shipping and Handling
If the value of ordered goods is equal to or exceeds 150.00 Euros, we deliver the ordered items free of charge to any postal address of your choice within the Federal Republic of Germany.
If the value of ordered goods comes to less than 150.00 Euros we charge you a flat-rate shipping fee of 4.95 Euros per order within the Federal Republic of Germany, 11.95 Euros for a delivery to Switzerland, Austria and all members of the EU. For delivery to any other country, we charge a shipping fee of 30.00 Euros. If you choose to pay by cash on delivery, we bill you an additional 4.30 Euros.

The method of payment is limited to prepayment and sometimes credit card payment. For shipping to Switzerland and Austria we have opened up an account with the “Postbank”, i.e. there are no additional banking fees. With each delivery, we charge 19% VAT. If you send us a customs bill of entry, we will refund the VAT amount.
Place of execution is our distributing warehouse, specified on our shipping bill. Any details concerning the delivery date and time are not binding, unless the delivery date has been explicitly confirmed.
Industrial sellers carry the risk of loss or damage during delivery.
We are entitled to deliver ordered items as they become available. If you are not interested in a part-delivery, but prefer all your items to be combined into one delivery, please note this when you place your order. If you agree to your order being delivered in several installments, we pay for any additional shipping charges.
Information concerning the German “Verpackungsverordnung” (Packaging Regulations)
Please make sure you dispose of any sales packaging, transport packaging, or additional packaging appropriately. Please check for any labels indicating that we take part in a system (e.g. “Grüner Punkt”) which is supported in your catchment area by a service which regularly collects used packaging from your doorstep or somewhere near-by.
According to § 6 para. 1 of the German “Verpackungsverordnung”, a lack of any such labels commits us to take back used and empty packaging at the place of delivery or in its immediate proximity, to dispose of them according to legal regulations, and to keep a record of our fulfillment of the “Rücknahme- und Verwertungsanforderungen”.
You may also take the packaging to a communal collection point or a waste management enterprise near you which collects the waste free of charge. Is this not the case, you may return any packaging to us by mail, and we will refund you the postal cost.
Guarantee
If a product happens to have a defect which we accept responsibility for, you may choose to either ask for a replacement or a correction of the defect in due time. In this case we cover the shipping cost for the return of your order. If a replacement or repair of the product is not possible, you have the right to revoke the contract (annulment) or cut the sales price (reduction).
Your guarantee is valid for 24 months, starting with the transfer of risk (“Gefahrenübergang”) according to § 4 para. 4.
Liability
In a case of liability, we assume unrestricted liability according to the “Produkthaftungsgesetz” (German Product Liability Act), in the case of a lack or deficiency of warranted qualities, as well as in cases in which the damage of a product has been wantonly negligently, or willfully, caused by us or our assistants.
In the case of slight negligence, we assume liability in the event of a culpable breach of contractual obligations (cardinal obligations); however, this is restricted to damage which is inherent to the agreement and foreseeable at the conclusion of the contract.
In all other events, FanSport24 does not assume liability.
We do not assume liability in particular for damage that may be caused by the downloading of data from the website of our company or for damage which may result from errors or the impossibility of using our shop’s website.
Privacy Protection Policy
We process your personal data in line with the effective Data Protection Act concerning the fulfillment of the sales contract (“Datenschutzgesetze zur Erfüllung des Kaufvertrages”). When you place your order, you automatically agree to our recording your personal data like e.g. your name, address and telephone number.
The personal data you provide us with is only requested, used and processed insofar as it is necessary for the grounds and composition or modification of the contractual agreement. We are entitled to share this data with any assisting parties that may be involved in the implementation of the sales contract, if it is necessary to share your personal data in order to comply with our rights and obligations stated in the sales contract.
Access to sales conditions: You are authorized to review the sales conditions on this website at any time. Your individual order details cannot be viewed over the internet for security reasons and are handled confidentially in accordance with our privacy policy.
Data protection: Customers’ data is recorded and processed by us in accordance with the respective regulations of the “Bundesdatenschutzgesetz” (BDSG) and the “Teledienstdatenschutzgesetz” (TDDSG).
Your personal data is only requested for specified, obvious, and rightful purposes and is not recorded longer than necessary.
You have a right to information, correction, blocking, and deletion of your recorded data. Please contact us via mail or fax. We do not provide third parties with your personal data, including your address and email adress.
Exempt from this regulation, however, are our service partners who require the transfer of data for the order process. In these cases, the amount of shared data information is restricted to a minimum.
We record your order details and send them to you with our ‘General Terms and Conditions’ via email. You may review the Terms and Conditions at any time. Your order details can be viewed after login.
Newsletter
Each customer is automatically registered in our email data base. The purchase of an item at our shop means that you are interested in our products, and you will therefore be informed about new products and special offers.

Miscellaneous
Exclusive of the United Nations Convention on Contracts for the International Sale of Goods and the German Private International Law, German Law applies, even if the delivery is carried out from abroad (EU and non-EU countries) or an order is delivered abroad (Eu and non-EU countries).
Insofar as you are a registered trader, Ehrenkirchen is the place of execution, as well as the sole place of jurisdiction. We are, however, in this case entitled to also file a suit at your home address. If you reside abroad, Freiburg is the legal venue for any claims made in connection with your order. This also applies in the case that your place of residence is not known at the time the suit is filed.
You are only entitled to your right to compensation or reduction if your counterclaims were legally established or if we have recognized them in writing.
